Terms of Service — NueWayve

 

1) Who we are
NueWayve (“we,” “us,” “our”) designs, builds, ships, and services premium aquarium systems. Questions: support@nuewayve.com.

2) Orders, pricing & payment
Quotes and listings are invitations to order; we may accept or decline any order. Prices exclude taxes, duties, brokerage, and shipping unless stated. You authorize us to charge the full amount due (including approved change orders).

3) Custom & built-to-order products
Most items (display aquariums, BayLine™ sumps, Wayve Galaxy™ stands, custom parts/finishes) are custom. Once production begins, custom items are final sale if as-described and undamaged. You may cancel within 24 hours of order confirmation for a full refund; after 24 hours the deposit is non-refundable and incurred material/labor costs may apply. Lead times are good-faith estimates and may change due to supply/logistics.

4) Shipping, delivery & inspection
Crated freight ships insured. Title/risk transfer at carrier handoff (or at on-site delivery for white-glove installs). Inspect before signing the BOL; photograph and note any damage (refuse if severe) and email us within 24 hours (visible) or 48 hours (concealed). Keep packaging until claims are resolved. 5) Services (White-Glove & WayveCare™)
Customer is responsible for clear access, adequate structural support, and any permits/approvals. Scheduling deposits are non-refundable if canceled within 7 calendar days of the appointment. Completed labor, consumables, and service visits are non-refundable. WayveCare terms supplement these Terms.

6) Returns, refunds & warranty
Returns/cancellations follow our Return Policy. Craftsmanship/performance issues are handled under our Warranty.

7) Specifications & tolerances
Industry-standard tolerances apply (e.g., minor edge variances/seed bubbles). Images may show optional features. We may make non-material design updates to improve performance/safety.

8) Third-party components
Systems may include third-party equipment/services (lighting, controllers, pumps) covered by those manufacturers’ terms/warranties.

9) Limitation of liability
To the maximum extent permitted by law, we’re not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits). Our total liability for any claim is capped at the amount you paid for the product/service giving rise to the claim.

10) Indemnity
You agree to indemnify and hold NueWayve harmless from claims arising from your breach of these Terms, misuse, or violation of law/third-party rights.

11) Force majeure
We aren’t responsible for delays/failures caused by events beyond our reasonable control.

12) Privacy
Your use of the site is also governed by our Privacy Policy.

13) Governing law & disputes
These Terms are governed by the laws of New York. Venue for any dispute will be in Erie County, NY courts (or small-claims, as applicable).

14) Changes
We may update these Terms at any time. The posted “Effective date” controls. Continued use or purchase after changes means you accept the updated Terms.
